Contract For Sale
The advertising of products on the site is the way in which we are able to display all the items available to buy through the Site. We aim to keep items in stock at all times but due to the very nature of our product range being imported or hand-made means that it is inevitable there will be breaks in supply in which case some lines will show 'Not Available'. It should not be possible to order any item that is not in stock. You can only place items in your basket that are currently in stock meaning that you can shop with confidence that the items that you have chosen will be with you within a few days.
However, on rare occasions, stock levels and prices may be incorrect and you will be contacted within 48hrs of you placing the order. That means your order is an offer, not a contract of sale between you and A Timeless Culture, so prices and stock availability would not be contractually confirmed until you receive the 'confirmation of despatch' email sent once your order has been successfully picked and we can confirm stock levels have been checked.
These Terms and Conditions cannot be varied except by changes made by A Timeless Culture on the Site, which we may make from time to time. In particular, nothing said by any representative of A Timeless Culture will operate as a variation to these terms and condition or constitutes a legal representation on behalf of either of them.

Please be aware that whilst we take great care to accurately describe the products shown on our Site, a lot of the items are hand made from natural materials and as such their composition and colour may vary slightly from that shown and are usually in most ways unique.
We will do everything possible to ensure that you can be confident of making a secure, risk-free purchase from us but In the unlikely event that you are unhappy in any way with our service or products, please contact us immediately and we will attempt to put things right or arrange for a return.
Making A Purchase
When you make a purchase from www.atimelessculture.com:
- You will receive an electronic confirmation upon receipt of your order as soon as your order has been received (unless your order has been made over the telephone)
- You will receive notification of dispatch usually within 1-2 working days of your order being processed.
It should not be possible to order any item that is not in stock. You can only place items in your basket that are currently in stock meaning that you can shop with confidence that the items that you have chosen will be with you within a few days. See our Contract For Sale above.

All prices are displayed in pounds sterling (GBP) with the currency converter to US Dollars and Euros. Your credit card company will charge you in your country’s currency at that day’s exchange rate. Local charges are not the responsibility of A Timeless Culture.

Cancellation of Order(s) – can be cancelled at no cost to you, if the item has not been posted or shipped. Please call or e-mail us, as soon as possible, if you decide to cancel an order, so that we can cancel the postage. Your credit card will be immediately credited, if cancelled item has not been posted.
If the item has been shipped, you will be responsible for paying the shipping costs for returning the merchandise to us. When returning a cancelled order, you must post or ship via a courier that provides tracking, and provide us with the tracking number. If the item is lost or destroyed in transit, you will be charged for the item. Therefore it is recommended that you purchase insurance from the courier, so you can be reimbursed for an item if it is lost or destroyed in transit.
For items cancelled after them are posted, your account will not be credited, until we receive the returned item. Cancelled orders, that have been posted, must be returned unopened.
Liabilities and Responsibilities
A Timeless Culture’s liability in contract, tort (including negligence or breach of statutory duty), misrepresentation, restitution or otherwise, arising in connection with the performance or contemplated performance of this agreement shall be limited to the price paid for the goods.
Nothing in these conditions excludes or limits the liability of A Timeless Culture for death or personal injury caused by the A Timeless Culture’s negligence or fraudulent misrepresentation.
The limitation on any exclusion from liability contained in these Conditions
shall be subject to the provisions of section 2(1) of the Unfair Contract Terms
Act 1977.
A Timeless Culture will not be liable in any amount for failure to perform any obligation under this agreement if such failure is caused by the occurrence of any unforeseen event beyond its reasonable control including without limitation Internet outages, communications outages, fire, flood, war or act of God.
Interpretation and Jurisdiction
These terms and conditions only cover the A Timeless Culture’s web site. Any other websites which you link to from this website are governed by their own terms and conditions. We accept no responsibility or liability for web sites that are not under our control. We are required by law to inform you that sales can only be concluded in English. These terms and conditions shall be governed by and construed in accordance with the laws of England and Wales and each party agrees irrevocably to submit to the exclusive jurisdiction of the courts of England and Wales.
Statutory Rights
All statements, guarantees or warranties in these terms of trading are additional to and do not affect your statutory rights. These terms and conditions are subject to change at any time without prior notice to you.
Payment
A Timeless Culture is committed to ensuring the security and privacy of information supplied by our customers. We use the world recognised PayPal and Protx® system to process payment whereby your credit card details are transferred directly from your computer to Protx’s® secure server using SSL encryption. A small padlock appearing in the lower right hand corner of your browser window will illustrate the security of this connection. If you are still concerned about providing your credit card details online, we are happy to accept payment over the telephone.
All transactions on our Site are guarded by a secure server with the latest encryption technology. This secure server codes all of your information, including your credit card number, so that it cannot be read or used by any party other than the credit card billing company. Even we can't read it, or access your credit card number in any way!
We can also accept payment by cheque or postal order. If you wish to do so, please make cheques, PO’s payable to A Timeless Culture and remember to include postage. Please also send us a covering letter detailing your Order, cheque guarantee card number, guaranteed amount, expiry date, contact details and delivery address. In our KAIZEN COLLECTION we use a lot of Swarovski, Austrian, Czech Crystals and Diamante in some of our other jewellery and in most cases these items are more dazzling and sparkly when you see them than when you view them on your computer monitors!!!
ATC will make every effort to ensure that the items you receive are identical to the items you ordered. Over 90% of our products are individually hand crafted and as such there may be a “very slight variation” in size, texture or dye lot colours.
